These Terms of Sale govern all commercial transactions related to the NEXTLEAD CRM platform, provided by CREACH AGENCY, a SAS (simplified joint-stock company) with a share capital of €2,500, registered with the Paris Trade and Companies Register under number 979 948 551, with its registered office at 60 rue François 1er, 75008 Paris, France.

1. Services Offered

NEXTLEAD is a SaaS (Software-as-a-Service) CRM platform available through monthly or yearly subscriptions, as detailed on the website https://nextlead.app.

2. Pricing

Prices are listed in euros and exclude VAT. CREACH AGENCY reserves the right to change its pricing at any time. The applicable price is the one in effect at the time of purchase or subscription renewal.

3. Payment Terms

Payments are made via secure credit card processing. Subscriptions are automatically renewed unless canceled by the user before the next billing cycle.

In the event of a failed payment, access to the platform may be suspended until payment is resolved.

4. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to fully executed digital services that have begun with the consumer’s prior express consent.

5. Cancellation

Users may cancel their subscription at any time via their account interface. The cancellation will take effect at the end of the current billing period.

No pro-rata refunds will be provided unless there is a proven and significant failure of service.

CREACH AGENCY reserves the right to terminate an account in the event of a serious breach of the Terms of Use.

6. Default in Payment

In case of payment failure or rejected charges, CREACH AGENCY reserves the right to suspend or terminate access to the service. Late fees may apply in accordance with applicable law.

7. Liability

CREACH AGENCY is committed to providing its services with due care, under an obligation of means. However, it cannot be held liable for indirect damages, data losses, or financial losses resulting from use of the CRM.
